    Provide the URL or other specific location on Giftod.com where the material appears.

  3. Your contact information

  4. Good-faith statement

    Include a statement that you have a good-faith belief that the disputed use of the material is not authorized by the intellectual property rights owner, its agent, or applicable law.

  5. Accuracy and authority statement

    Include a statement, made under penalty of perjury, that the information contained in your notice is accurate and that you are the intellectual property rights owner or are authorized to act on behalf of the rights owner.

Our Response to Infringement Notices

When Giftod receives a sufficiently complete infringement notice, we will review the information provided and may take appropriate action.

Where appropriate, this may include removing or disabling access to the allegedly infringing content while the matter is reviewed.

Giftod may also take appropriate action regarding repeat infringement when required by applicable law or our policies.

Submitting a notice does not automatically guarantee that content will be removed. We may request additional information if necessary to evaluate a claim.

Counter-Notification

If content you provided was removed or disabled as a result of an infringement notice and you believe the removal was caused by mistake or misidentification, you may submit a counter-notification.

DMCA Counter-Notification

Your counter-notification should include:

  1. Identification of the content that was removed or disabled and the location where it appeared before removal or disabling.
  2. A statement, made under penalty of perjury, that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification.
  3. Your full name, mailing address, telephone number, and email address.
  4. A statement consenting to the jurisdiction of the appropriate United States Federal District Court as required under applicable law and agreeing to accept service of process from the person who submitted the original infringement notice or that person's agent.
  5. Your physical or electronic signature.

After receiving a valid counter-notification, Giftod may provide a copy to the party who submitted the original infringement notice.

Where applicable under the Digital Millennium Copyright Act (DMCA), removed content may be restored after the applicable statutory period unless the original complaining party informs us that legal action has been filed seeking a court order to prevent restoration of the content.

Important Notice

Under Section 512(f) of the Digital Millennium Copyright Act, a person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.
